Priscilla DeGois successfully defended a radiologist against an Eighth Amendment claim brought by a plaintiff in the U.S District Court for the Northern District of California.  Plaintiff alleged Ms. DeGois’ client was deliberately indifferent to his serious medical needs, resulting in permanent injury to his shoulder and requiring future reconstructive surgery.  In her Motion to Dismiss, Ms. DeGois persuasively argued that the factual allegations did not give rise to a claim upon which relief could be granted.  The Court agreed and dismissed Ms. DeGois’ client from the action.
